You wouldn't believe it since my husbands official release date is 18 months away, but he has already started the release process. There is so much involved that it is a bit overwhelming. He has had his official paperwork submitted and is now at the beginning of the waiting period that is our federal justice system.
He has submitted the address of the residence where he would like to be released to. It is a home owned by a family member since we are not sure it would be a great idea for him to return to this small community. I am told that an officer will contact that family member so that the house can be approved for him to move into upon his official release. That house is located in a different Federal District so he will have to get all his paperwork transferred to the new district as well.
He is in the final few months of his program which is suppose to ensure that he gets as much half-way house time as possible. What that means is that he can be released from the prison facility and sent to be supervised in a half-way house closer to his intended release location prior to his official release date. That gets him closer to home, but he is still under strict supervision yet he is allowed a bit more freedoms as he earns them. He will be allowed to hold a real job while he is there, day passes to spend with us and eventually weekend passes. He could eventually even be released from living in the half-way house early if he has a job and a place to live however, he will not be released early of there is no one else living with him in the house, so he will have to serve out the remainder of his time at the half-way house. Oh, and the half-way house gets a large percentage of any money he makes while under their supervision.
Everything that we learn comes with even more questions and no one is around to answer any of them. We all get our information from each other, other inmates, and anyone else we know further down this path than ourselves. We get bits and pieces here and there and sometimes it is mis-information but we keep moving forward.
That is all I know right now and things change from day to day. I am sure by the time you are reading this I will have more information or been told that something else we believed is not really true. Hopefully the information I pass on to you, is based on fact and everything that I am certain of. Looking to a better new year when he will be closer to home.

Hi I know your posting is 4 years old but I'm hoping for a response. I too am a spouse of an inmate. My husband still hasa few years left but I had some questions. He is incarcerated in California and I will be moving to Las Vegas about two years before his release. Do all federal inmates have to go to a hwh? Also what If he has trouble finding a job to pay for his stay?
ReplyDeleteNot all federal inmates are required to spend time in a half way house and many are never approved to stay in one. There is a process that starts about 18 months before their release date which will determine if they will be required to stay until their actual release date or allowed to go to a half way house for a specific period of time. If he does get into a hwh, the counselors are aware of the job markets in the surrounding area and in my experience have been positive when it comes to finding work. They understand that it is not something that will happen over night but they do expect the inmates to "work" at finding some kind of employment. Some of the guys I know have found work fairly quickly while it took others a longer period of time, but the good news is, the ones that put in the effort found some kind of employment.
DeleteMy brothers sentence is done in March of 2018. I have read that federal inmates can get 54 days a year off the sentence for good behavior. That would mean that he could be done late February 2017. He is in some kind of program that could knock another 18 months off his sentence. I don't believe that is happening. Have you ever heard of any federal prisoner getting out before the end of their actual sentence? How far in advance does the prisoner know their release date?
ReplyDeleteAll of what you heard is true. As long as an inmate serves more than a year they are eligible for Good Time and that starts right away. On a five year sentence it amounts to about 6 months. You can go to the Federal BOP website, type in the inmates name or number and it will tell you the tentative release date with the Good Time calculated in. That would be his official release date as of today. By the way, if it falls on a weekend they should let him out the Friday before. Now the 18 month program that I know that takes time off is called the Rdap. It is a drug and alcohol rehab program. Usually they get out 18 months early with 6 months of halfway house time. That date will not be reflected on the BOP website. Well informed inmates will have a better idea of their actually release date. Keep in mind though that while they are in the half way house they are still considered under the BOP. Hope that helps some.
DeleteMy boyfriend is doing time in federal prison and will gradguate the drug program on friday NOV, 17 0f 2017 and his release date on the BOP website says he will released May of 2018... But he said he is approved to go to a halfway home after he graduates the program... So if his graduation from the program is this friday Nov 17? and his actual release is in May of 2018? when is he going to be notified that someone could go pick him up to take him to the halfway home? Cuz as of now? he`s clueless of the actual release date from prison... And since I`m the driver that`s going to go pick him up, I would like to know about when to start booking the hotel and start getting ready... Thank you.
DeleteIf they have not given him any information about dates and times for a HWH, I would guess it may be some time before he needs a ride. Technically his actual release date does not change since the HWH is still considered under the supervision of the BOP. The HWH is just another extension of incarceration. If you know which HWH house he is supposed to be released to, you may want to call them and find out if they have any information about an approved release date.

DeleteIn a normal release process for federal prison, the inmate has a specific date of release. In advance he makes arrangements to be picked out outside the facility by friends or family or works with the BOP for transportation home. They will supply money for a bus home and make arrangements for transportation to the local bus station. Then they will have a certain number of days before they will have to check in with their probation officer and that usually accounts for travel time from the prison to home. I do not know however if this will apply because your husband was already in the halfway house. Without knowing the circumstances I can only guess that he would still have a normal release on his release date. Parole might contact you or they might not. There is no consistency between different offices. It is communication between you and your husband that will figure out how he will know get home. But if you can, you would be allowed to pick him up at the prison on the morning of his release.

ReplyDeleteIf he is in the federal system he would need to list the address that he wants to physically return to, so that would be your new address. Depending on the PO, they may come to the home or call and verify that you want him released to that address.

ReplyDeleteThere are a bunch of places to look online for the formula for calculating the good time, but I would suggest just going to the BOP.gov website and looking up your husbands name. The calculation of the time is actually pretty complicated. The BOP site will give you "THE" actual release date with good time already calculated in. It would not include the RDAP program until he gets closer to his actual release date. RDAP can take 18 months off the prison time if they get 6 month HWH time. Keep in mind though that even with the HWH time they are still considered under the supervision of the BOP and the release date is the date that he would be finally released from the BOP. There are way too many moving parts and variables to come up with an exact date but the BOP would give you a realistic guideline to figure backwards from since that is the date that they will be using for everything anyway.

The only problem is he has stopped all communication with me intentionally. He told me there was no way he could have me pick him up and that he couldn't use my address for release. Is there a way that I could find out a more precise date and halfway house he could be released to? The kids and I continue to wait for him but if he has other plans then it would be great to move on with our lives.
ReplyDeleteIn most areas there are not too many half way houses that accept federal inmates. I found a list of the acceptable HWH on my local federal district web site. Not sure though if the HWH would give out any information over the phone. It is hard enough getting answers when you have contact with the inmate, I am not sure if it is at all possible to get the information without him. You could also try contacting his counselor inside. They are the ones that co-ordinate the release so they would have all the information. Does he have any other family members that he could be listing as a place to live, like a sibling of a parent? They might have some more information.

I will try to contact his counselor. I thought I was the only one there for him but obviously there must be someone else? He was the only one I could get any information from. To be honest he believes I'm out here being promiscuous, he has came to the conclusion that I must have been with another man. My kids know the truth and that's all I need. We are legally married but he doesn't want a divorce. Maybe he doesn't want to pay child support? This has become a nightmare for me. The kids continue to ask for him but I don't know what to tell them anymore. Thanks for your advice.

Will I even be allowed or does it have to be someone who was approved to visit only? Do you happen to know if its 48 or 72 hrs from release to check in with probation? ReplyDeleteHello. My husband was sentenced to 36 months in 2014, He received a notice that gave his earliest release date as 01/09/17, but his max date on BOP.GOV site is 04/26/17. He is in Lewisburg federal camp but he did NOT participate in the rdap program. He believes that they will release him "anyday" now, however, he his counselor is not giving him any real details. Is it possible that they will just call him and say "inmate "" you are released, pack up"? He tells me to just be ready to come get him anyday. I live 11 hours away from Lewisburg. He is also giving away all his things and telling everyone I'm going home in a few days.... I am worried that he will not be released until 04/26/17, his BOP.GOV date. Is there a way to find out if he is leaving the camp "any day now" or he will be there until his 04/26/17 date? I just want him to relax and stop giving away all his things if he is not getting out.
ReplyDeleteMy guess it that the date that is on the BOP site is his release date although I am not completely familiar with the Camp Protocols I imagine the BOP is still the BOP. I would have thought his counselor would have had some conversations with him by now if he was getting out next week. I am certain they would not just release him with no advanced notice. The BOP has to make arrangements for his release as much as you do. The only other possible answer would be if he was being released to serve the last few months at a half way house but again that would not be without some advanced planning.

My boyfriend just corrlinked me saying that he has to go talk to the Lieutenant and that he might be put in the hole. Well he suppose to turn in my new address on the 15th when his case worker gets back. He suppose to get out next year August 9th after they took his year away from him over a $35 fine. Let me warn all who has a love one in the rdap make sure you have their fine in on one the first of every month. We was told that his needed to be paid on the 10th and so I wire it every 10th in the early am with my app. Well April of last year they decided to take it out on the 7th instead and violated him. Even though he had already graduated from the rdap program and I drove from Texas to MS to pay his fine with the court directly the next day. Then faxed them the receipt. They still disqualified him from the program over $35 that was paid and that is not their fine. They only process the fine and send it to the court that he owes. So be very careful with their fines.

ReplyDeleteI don't know about signing him out. My husband served until his actual release date so he was free to walk out the door regardless of who took him home. I don't know if that is different for half way house releases.

ReplyDeleteI am not completely sure. I know that there are inmates that come up as "Not in BOP custody" but they do not have release dates. A guess would be that they are currently in a state or local facilities custody at this time.

ReplyDeleteWithout BOP.gov I am not sure how you would know when he was being released. However, with 1 year and 1 day he would qualify for the good time credit which is approximately 54 days per year served so that would be about 10 months served. Your husband should be able to get the exact date from his counselor as well.

ReplyDeleteThe BOP starts the release process up to 18 months before the actual release date. If it is getting close, your husband should have been informed of his release date because he would have had to list the address that he was planning on returning to after his half way house time. He should also know his date to transfer to the half way house as well since you could pick him up and transport him to the half way house.

DeleteSince my husband was not granted HWH time, I am not sure when they know exactly how much time he will spend there. My experience with other friends, however, is that the half way house may be a good place to start. They would have to know when to expect him and have a bed ready. The BOP should really get better at sharing information with inmates and family members. This is really important if family members are picking up the inmates and transporting them to the HWH.

ReplyDeleteIt is neither good nor bad. Many PO's are overburdened and don't bother to take the time until they absolutely have to stop by the home. If there are no obvious issues with the home location it should not be a problem. The PO may stop by while he is in the HWH or they may even wait until he is actually home.

ReplyDeleteHe will be released on his scheduled release date no sooner. That date already takes into account any good time he will have. The only thing that will change that is if he is participating in any special programs that would take additional time off like the RDAP program.

ReplyDeleteProbation is supposed to do a home visit but my experience is that they do them if and when they have the time. Some are done before the inmate is released and some don't come by until after the inmate is home or in the halfway house. One rule that gets bounced around is if the inmate lived there before incarceration then they are usually OK to be released to the same address. Then probation does their first walk through after they are home.

That means probably not until he is already in the half way house. If they don't come, your finance will initially be allowed to come home to your address.

ReplyDeleteHe has to be approved for the HWH. If he does not get the approval, he will serve his full sentence and be released. They may just do a quick residency check and if there are not problems he could come home and reside with you.

ReplyDeleteYou are the second person to ask that in the last few months. I am wondering if some policy has changed in the last few years. The BOP automatically ordered a new Social Security card for my husband prior to his release. It was a standard procedure at that time. Even though he did not need it, he still had his card. But it was one of those things they did for everyone. But since the BOP is anything but consistent, I wonder if that policy varies by facility as well. The counselor may be asking for it, so they know whether to order one for your husband, and so he would have it on him when they release him. And I asked my husband about his birth certificate because I never sent one near release time and I could not remember if I had sent one in to my husband at some point during his time in. I do think he had a copy, certainly not the original.
DeleteIt is normal to begin processing for release this early. They actually start the process 18 months before. Time will really start to fly now and then the last few months will drag. Enjoy the time together once it gets here.
Hello , My brother is in Federal custody and the US Probation officer just came and did a home inspection. The House was approved. Do you know how far in advance the do the inspection before he is to be released?
ReplyDeleteIt varies by Probation office. The best thing to do is to Log into BOP.gov and go to inmate search. Type in your brothers information and the web site will give you his release date from the BOP. Good Luck.
DeleteMy boyfriend got his computation sheet and it says that he is eligible for home confinement on 1/24/18. His case manager was out during that week and will return 1/30/18. How long does it take for the unit managers and the counselors to get the paperwork together to get him on home confinement. His release date is 5/2018. I've been searching the internet to get the procedure for BOP home confinement release. Wondering if he must go through the halfway house before coming home.

As of now they have his release as the place he was arrested in Nevada. I cant get anyone on the phone and he makes like he cant get anyone to help him. When i did speak to someone they said he had to be there for a year before he makes any suggestions or changes or requests for release? ReplyDeleteMy experience and from others I have heard, it is all handled through the BOP by your husbands counselor. It is all paperwork that is filled out and processed through the Prison. I do know that sometimes you have to get on the counselors to make sure things do get done on time and correctly. I do not believe they can be releasing him to Nevada if there is no residence or home to release him to. They are supposed to do some kind of residency check and if there is no home of record in Nevada I don't know how they would do that. You can try contacting the local probation office to ask questions but they may not be very helpful since he is not their problem yet. Good Luck.

Due to several delays with his case he served the bulk of his time before hand and had about 5 months remaining based upon his sentencing, right before the holidays. He was hoping that they would send him to a half way house after sentencing but everything shut down for the holidays and by the time he got a meeting with his counselor it was a month later. He checked last month and the counselor said they hadnt even submitted his paperwork yet. Now that we are about two months out should I be concerned that we still havent heard anything? Is this normal? Should they have already reached out to me or will it be closer to his release date? Would the delay his release date for some reason?
